(A) A competent person shall constantly attend any fire permitted by this chapter until the fire is extinguished. This person shall have a garden hose connected to the water supply, or other extinguishing equipment readily available for use.
(B) No person shall conduct, cause or permit open burning during a burning ban put into effect by a local authority, county or state agency (M.S. § 88.171 subdivision 9, as it may be amended from time to time).
(C) Exemption to conduct fires under this section does not excuse a person from the consequences, damages or injuries which may result there from nor does it exempt any person from regulations promulgated the Minnesota Pollution Control Agency or any other governmental unit excising jurisdiction in matters of pollution or fire hazard regulations.
(D) Any person who violates any provision of this subchapter is guilty of a misdemeanor.
