8-8-1: REQUIREMENTS:
All swimming pools having a capable depth of two feet (2') or more shall conform to the requirements and standards under the international building code as adopted by the village. Included in those requirements are the following:
   (A)   A swimming pool or appurtenances thereto shall not be constructed, installed, enlarged or altered until construction documents have been submitted and a permit has been obtained from the code enforcement officer.
   (B)   At least one means of egress shall be provided from private pools.
   (C)   Outdoor private swimming pools shall be provided with a barrier which shall comply with the following:
      1.   The top of the barrier shall be at least forty eight inches (48") above finished ground level. Where the tip of the pool structure is above finished ground level, such as an aboveground pool, the barrier shall be at finished ground level, such as the pool structure, or shall be mounted on top of the pool structure. Openings in the barrier shall not allow passage of a four inch (4") diameter sphere.
      2.   Gates shall be equipped with self-closing and self-latching devices designed to keep, and capable of keeping, such gate securely closed at all times when not in actual use. Deck and stair gates should be installed at the bottom of the stairs and should swing out away from the pool. However, if design restrictions prevent the installation of the gate as described above, and the gate must be installed at the top of the stairs, that gate should swing in order to prevent potential stair accidents.
      3.   Where an aboveground pool structure is used as the barrier or where the barrier is mounted on top of the pool structure and the means of access is a ladder or steps, the ladder or steps shall be capable of being secured, locked or removed to prevent access, or the ladder or steps shall be surrounded by a barrier that meets international residential code requirements.    (D)   All outdoor swimming pools are considered accessory uses and shall meet minimum yard requirements, however, no portion of any private swimming pool or appurtenant equipment (including pumps, filters, and heaters) shall be located at a distance less than five feet (5') from any side or rear property line and may not be placed in any front yard. Corner lots will be considered as having two (2) front yards. (Ord. 06-30, 8-21-2006)
   (E)   All electrical devices used in conjunction with or connected to all pools must be grounded and protected by approved ground fault interrupt circuits.
   (F)   An approved pool cover shall be installed during those periods when use of the pool is discontinued. Unused pools on residential premises not occupied or dwelt in for a period of thirty (30) days or more shall be completely drained or equipped with an approved pool cover. Abandoned pools, as determined by the code enforcement officer, shall be removed or filled to the grade of adjacent land. (Ord. 99-06, 6-21-1999; amd. Ord. 06-23, 7-17-2006)
