7-12-1: DEFINITIONS:
For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
BURGLARY:
Any violation as defined in the following sections of the Illinois Criminal Code of 2012, as amended from time to time: "Burglary" (720 ILCS 5/19-1); or "Residential Burglary" (720 ILCS 5/19-3).
CANCELED, SUSPENDED OR REVOKED REGISTRATION:
A violation of section 3-702 of the Illinois vehicle code 1 , as amended from time to time.
CONTROLLED SUBSTANCE:
Any substance as defined and included in the schedules contained in article II of the Illinois controlled substance act 2 as amended from time to time, and cannabis as defined in section 3 of the cannabis control act 3 , as amended from time to time.
CONTROLLED SUBSTANCES VIOLATION:
Except as otherwise authorized by law including, but not limited to, the Cannabis Regulation and Tax Act or the Compassionate Use of Medical Cannabis Pilot Program Act, a violation of one or more of the following statutes of the Illinois Controlled Substances Act or the Illinois Cannabis Control Act: "Manufacture or Delivery of a Controlled Substance" (720 ILCS 570/401); "Controlled Substance Trafficking" (720 ILCS 570/401.1); "Possession of a Controlled Substance" (720 ILCS 570/402); "Possession of More than 10 Grams of Any Substance Containing Cannabis" (720 ILCS 550/4); "Manufacture or Delivery of Cannabis" (720 ILCS 550/5); "Cannabis Trafficking" (720 ILCS 550/5.1); "Delivery of Cannabis on School Grounds" (720 ILCS 550/5.2); or "Unauthorized Production or Possession of Cannabis Sativa Plant" (720 ILCS 550/8).
DRIVING UNDER THE INFLUENCE:
Any violation as defined in §11-501 of the Illinois Vehicle Code (625 ILCS 5/11-501), as amended from time to time.
DRIVING WITHOUT A VALID DRIVERS LICENSE:
A violation of §6-101 of the Illinois Vehicle Code (625 ILCS 5/6-101), as amended from time to time, where the driver's license or driving privileges have never been obtained, or previously have been obtained and have been expired for not less than six (6) months.
DRIVING WHILE LICENSE, PERMIT OR PRIVILEGE TO OPERATE A MOTOR VEHICLE IS SUSPENDED OR REVOKED:
Any violation as defined in §6-303 of the Illinois Vehicle Code (625 ILCS 5/6-303), as amended from time to time, except for suspensions resulting solely from violations of vehicle emission requirements.
DRUG PARAPHERNALIA:
Any paraphernalia, articles or equipment commonly used in aiding the consumption or ingestion of controlled substances or cannabis, as defined by the Illinois Controlled Substance Act, including, but not limited to: cocaine spoons and vials; pot pipes; water, carburetor, electric or air-driven pipes; hypodermic needles; syringes; carburetion tubes and devices; chillums, ice pipes, chillers, and bongs.
DRUG PARAPHERNALIA VIOLATION:
Except as otherwise authorized by law, including, but not limited to, the Cannabis Regulation and Tax Act or the Compassionate Use of Medical Cannabis Pilot Program Act, the possession of Drug Paraphernalia, except if such Drug Paraphernalia is prescribed for strictly medical purposes and is used as such.
EXPIRED REGISTRATION:
A violation of section 3-414 of the Illinois vehicle code 4 , as amended from time to time.
FLEEING AND ELUDING:
Any violation as defined in §11-204 of the Illinois Vehicle Code (625 ILCS 5/11-204), as amended from time to time.
HEARING OFFICER:
A certified hearing officer.
OPERATION OF A MOTOR VEHICLE WITHOUT A VALID DRIVER'S LICENSE:
A violation of section 6-101 and/or section 6-303 of the Illinois vehicle code 5 , as amended from time to time, where the driver's license or driving privileges have been suspended, revoked, canceled, never obtained, or previously had been obtained and have been expired for not less than six (6) months.
OWNER OF RECORD:
The record titleholder to a motor vehicle.
PROSTITUTION:
A violation of section 11-14 of the criminal code of 1961 6 , as amended from time to time.
RECKLESS DRIVING:
A violation of §11-503 of the Illinois Vehicle Code (625 ILCS 5/11-503), as amended from time to time.
RETAIL THEFT:
Any violation as defined in §16-25 of the Illinois Criminal Code of 2012 (720 ILCS 5/16-25), as amended from time to time.
ROBBERY:
A violation of one or more of the following statutes of the Illinois Criminal Code of 2012, as amended: "Robbery" (720 ILCS 5/18-1); or "Armed Robbery" (720 ILCS 5/18-2).
SOLICITING FOR A PROSTITUTE:
A violation of section 11-15 of the criminal code of 1961 7 , as amended from time to time.
UNLAWFUL USE OF WEAPONS:
A violation of section 24-1 of the criminal code of 1961 8 , as amended from time to time.
WEAPONS VIOLATION:
A violation of one or more of the following statutes of the Illinois Criminal Code of 2012, as amended: "Unlawful Use of Weapons" (720 ILCS 5/24-1); "Unlawful Possession of Firearms and Firearm Ammunition" (720 ILCS 5/24-3.1); or, "Unlawful Sale or Delivery of Firearms on the Premises of any School" (720 ILCS 5/24-3.3).
