4-1-4-17: POSSESSION/USE OF CANNABIS OR DRUG PARAPHERNALIA:
   (A)   Except as otherwise authorized in the Cannabis Regulation and Tax Act, it shall be unlawful for any person to knowingly possess more than thirty (30) grams of Cannabis Flower, more than five hundred (500) milligrams of THC contained in cannabis-infused product, more than five (5) grams of cannabis concentrate. It is also unlawful for anyone to grow or possess cannabis plants unless they are a patient under the Compassionate Use of Medical Cannabis Act.
   (B)   It is unlawful for anyone under the age of twenty-one (21) to possess or consume cannabis unless they are a patient of the Compassionate Use of Medical Cannabis Act.
   (C)   It is unlawful for anyone to use Cannabis in a Public Place or in Public View: If possessed in public or a motor vehicle it must be packaged in a sealed, odor-proof, and child resistant cannabis container.
   (D)   It is also unlawful for any person to be in the possession of drug paraphernalia as defined by the Drug Paraphernalia Control Act.
   (E)   Any person found in violation of the provisions of this section shall be fined not less than one hundred dollars ($100.00) and not more than two hundred dollars ($200.00) for each offense. Each day a violation continues shall constitute a separate and distinct offense.
   (F)   Violations of this section may be administered in accordance with the provisions of title 1, chapter 17, "Administrative Adjudication", of this Code. (Ord. 19-13, 8-5-2019, eff. 1-1-2020; amd. Ord. 19-32, 1-21-2020)
