(A) It shall be unlawful for any person to knowingly do any act in such an unreasonable manner as to alarm or disturb another and to provoke a breach of the peace in an establishment licensed to sell alcohol, or upon any sidewalk, street, alley, or other public property in the vicinity of an establishment licensed to sell alcohol.
(B) It shall be unlawful for any person to quarrel, fight, or to commit any assault or assault and battery in an establishment licensed to sell alcohol, or upon any sidewalk, street, alley, or other public property in the vicinity of establishment licensed to sell alcohol.
(C) It shall be unlawful for any retailer licensed to sell alcohol to suffer any person to engage in any conduct referenced in subsections (A) and (B) of this section in the establishment for which it is licensed to sell alcohol, or upon any sidewalk, street, alley, or other public property in the vicinity of such licensed establishment.
(D) It shall be unlawful for any retailer licensed to sell alcohol to:
1. Fail or refuse to contact Police if an incident as referenced in subsections (A) through (C) of this section occurs in or outside that establishment.
2. Fail or refuse to allow Police to view and/or make copies of any video recording which may have recorded an incident as referenced in subsections (A) through (C) of this section regardless of any claim that the video recording equipment failed to depict the incident or was otherwise inoperable at the time of the incident.
3. Fail or refuse to provide the names of individuals involved in an incident as referenced in subsections (A) through (C) of this section or provide a description of the incident to Police.
(E) Any individual, corporation, partnership or other entity licensed to sell alcohol may be held liable for the acts or omissions of its employees/agents in violation of this section. (Ord. 16-38, 4-3-2017)
