§ 130.08 URINATING AND DEFECATING PROHIBITED IN CERTAIN LOCATIONS.
   (A)   Offense. A person commits an offense if the person urinates or defecates:
      (1)   On public property or in a public place, and is reckless about whether another is present who will be offended or alarmed by the act, unless the person is in an enclosed restroom or similar facility designed to handle waste in a sanitary manner; or
      (2)   On private property that the person does not own, unless the person has permission from the property owner, and is reckless about whether another is present who will be offended or alarmed by the act; or
      (3)   On private property that the person owns, and is reckless about whether another is present who will be offended or alarmed by the act.
