§ 113.03 CERTIFICATE OF NECESSITY AND CONVENIENCE.
   Upon authorization by the City Council, a certificate of convenience and necessity shall be signed by the City Manager, or person designated by the City Manager, and shall contain the name and address of the applicant, a declaration that the public convenience and necessity require the services of the applicant and the terms and conditions of the certificate. The applicant shall be required to sign the certificate and agree to the terms thereof. No certificate shall be transferable without the written consent of the City Council. Transfer of a majority interest in the company to which the certificate is issued, change of ownership or change in partnership shall be considered a transfer under this section. Any taxicab owner or operator licensed under the provisions of this code as of the enactment of this section shall not be required to reapply until the expiration of the existing license. A certificate issued under this section and a driver's permit issued pursuant to this subchapter shall be in effect for one year from the date of the certificate or permit unless suspended or revoked pursuant to the provisions of this subchapter. A certificate or permit issued under this subchapter shall be renewed annually unless the City Manager notifies the applicant in writing of his/her intention to deny renewal due to a failure of the certificate or permit holder to abide by the provisions of this subchapter. The applicant may file notice of appeal in writing with the City Manager, and the appeal shall be heard within 30 days by the City Council. The City Council shall affirm, reverse or modify the decision of the City Manager with regard to renewal of a certificate or permit, and its decision on the appeal shall be final.
