(A) It shall be unlawful for any person to knowingly leave parked or standing any motor vehicle for a period of more than 48 hours on public property, on private property without the consent of the owner or person in control of the property or on the right-of-way of a designated county, state or federal highway. It shall also be unlawful for any person to knowingly leave parked or standing any motor vehicle for more than 12 hours on a turnpike project constructed and maintained by the Texas Turnpike Authority. Any vehicle left parked or standing in violation of this section shall be presumed to be an abandoned vehicle.
(B) Any vehicle left parked or standing in violation of this section is hereby declared to be a nuisance per se and the fact that any person in whose name the vehicle is registered allows, permits or suffers the vehicle to be left unattended shall be prima facie evidence that the registered owner unlawfully and knowingly parked or left the vehicle.
(C) The Chief of Police shall have the authority to direct the removal, impoundment and/or disposal of vehicles in violation of this section in accordance with the procedures set forth by state law on abandoned vehicles and/or traffic on highways.
