§ 53.05 DRAINAGE CHARGES.
   (A)   The following schedule of drainage charges is hereby levied beginning January 1, 2016, against all real properties within the city, subject to drainage charges under Tex. Loc. Gov’t Code Ch. 552, subchapter C, subject to the exceptions set forth in the divisions below.

   (B)   The City Council may change, adjust, and readjust the rates and charges established herein for drainage services from time to time
   (C)   The following properties are exempted from drainage charges:
      (1)   Properties owned by the city and other governmental entities;
      (2)   Properties with proper construction and maintenance of a wholly sufficient and privately owned drainage system; and no potential impact on any city-owned or maintained property;
      (3)   Properties held and maintained in its natural state, until such time that the property is developed and all of the public infrastructures constructed has been accepted by the city;
      (4)   Any subdivided lot, until a structure has been built on the lot and the city has approved a final inspection for the structure;
      (5)   Vacant or agricultural properties without any structures, pavement, or improvements that create an impervious surface: and
      (6)   The primary residences of persons who qualify for the "Over 65 Property Tax Exemption".
   (D)   (1)   Where there is more than one user of a benefitted property because there are multiple occupants or multiple tenants, the officially-designated user, or party responsible for payment of the drainage charges, shall be:
         (a)   The common owner of the subject property or properties on a benefitted property if multiple utility accounts exist within a single benefitted property belonging to the same owner;
         (b)   The owner of the property if a benefitted property has changed occupants or tenants two or more times within a 12-month period.
      (2)   Such designation shall have no effect on responsibility for payment of water, sewer or solid waste charges.
   (E)   The City Council may change, adjust, and readjust the rates and charges established herein for drainage services from time to time.
