If the city denies coverage to a plan member, the plan member may seek a determination of coverage by a court of proper jurisdiction in Tarrant, Johnson or Ellis County, Texas. If the court rules in favor of the plan member, the city shall provide the plan member all benefits under the plan and shall reimburse the plan member for the reasonable attorney fees, expenses and costs incurred in obtaining the determination of coverage.
