6-1-3: HOW TO USE THIS CHAPTER:
The Village Engineer shall be responsible for fulfilling all of the duties listed in section 6-1-4 of this chapter.
To fulfill those duties, the Village Engineer first should use the criteria listed in section 6-1-5, "Base Flood Elevation", of this chapter to determine whether the development site is located within a floodplain. Once it has been determined that a site is located within a floodplain, the Village Engineer must determine whether the development site is within a flood fringe, a regulatory floodway, or within an SFHA or floodplain on which no floodway has been identified. If the site is within a flood fringe, the Village shall require that the minimum requirements of section 6-1-6 of this chapter be met. If the site is within a floodway, the Village Engineer shall require that the minimum requirements of section 6-1-7 of this chapter be met. If the site is located within an SFHA or floodplain for which no detailed study has been completed and approved, the Village Engineer shall require that the minimum requirements of section 6-1-8 of this chapter be met.
In addition, the general requirements of section 6-1-9 of this chapter shall be met for all developments meeting the requirements of section 6-1-6, 6-1-7, or 6-1-8 of this chapter. The Village Engineer shall assure that all subdivision proposals shall meet the requirements of section 6-1-10 of this chapter.
If a variance is to be granted for a proposal, the Village Engineer shall review the requirements of section 6-1-11 of this chapter to make sure they are met. In addition, the Village Engineer shall complete all notification requirements.
In order to assure that property owners obtain permits as required in this chapter, the Village Engineer may take any and all actions as outlined in section 6-1-13 of this chapter. (Ord. 613, 4-5-1995)
