5-8-3: FIRE PROTECTION DISTRICTS:
   A.   Fee Established: As a condition to the issuance of a building permit for any residential dwelling unit, the building permit applicant shall pay to the village a fire protection district fee. Such fee shall be collected by the village for the benefit of the fire protection district in whose jurisdiction the property is situated. The actual amount of fees collected shall be disbursed to the applicable district annually at the end of the village's fiscal year. (Ord. 797, 12-16-2003)
   B.   Amount: The amount of the fee shall be established annually or from time to time by a resolution of the village president and board of trustees. (Ord. 941, 3-6-2007, eff. 5-1-2007)
   C.   Method Of Payment: The cash contributions required hereunder shall be made by certified check or money order payable to the village and shall be deposited with the village. The village clerk shall keep a record of these receipts.
   D.   Indemnification; Hold Harmless; Release: The village shall not collect funds under this section for any taxing body which does not, prior to the effective date hereof, enter into an intergovernmental agreement with the village which provides that such taxing body will hold harmless, indemnify and release the village upon such terms and conditions as are acceptable to the village.
   E.   Funds:
      1.   Accounting: Each district receiving funds under this section shall annually make a written report to the village detailing the amount of funds received and how such funds were expended. This report shall be provided to the village prior to January 15 of each year. The village shall not disperse future funds to a district until the written report detailing the amount of funds expended for the previous calendar year has been accepted by the village.
      2.   Expenditure: All fees collected under this section shall only be expended toward the purchase of capital improvements, including, but not limited to, property acquisition, construction of structure, additions and improvements to existing structures, purchase of fire apparatus and purchase of ambulance or other rescue equipment, and bond payments related to these eligible expenditures. Annual operational expenditures are not an eligible expenditure of these contributions.
   F.   Periodic Review: The village shall review this section every three (3) years to determine whether the cash contribution herein set forth is consistent with current criteria. (Ord. 667, 3-3-1998, eff. 5-1-1998)
