The following words, provisions, and paragraphs shall be added to the following designated sections of the code adopted in section 3-7-1
of this chapter. These provisions supersede the requirements of the indicated provisions of such code.
101.1 Village of Manhattan.

104.1 See the village of Manhattan fee schedule.
108.1 Membership. Said board shall consist at all time of the then duly qualified and acting mayor of the village of Manhattan and the village board of trustees of the village of Manhattan who shall appoint a person as "code official" to perform the duties provided in this code for the code official. 302.4 Shall be deleted in its entirety and the following inserted in lieu thereof:
302.4 Grass And Weeds.
A. Lawn grass shall include all species of grass normally grown as a permanent lawn in the area, whether sodded, plugged, sprigged or seeded.
B. Lawn grass shall be installed and properly maintained on all property within nine months after an occupancy permit has been issued.
C. All premises and exterior property shall be maintained free from weeds or plant growth in excess of 8". All noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs; provided however, this term shall not include cultivated flowers, gardens and areas of native prairie plantings that have been approved by the village.
D. The owner and/or occupant of any premises that abuts public property, whether from the front, one of the sides or in the back between the public street (a.k.a. the public right-of-way, parkway, shoulder, cause-way or berm) and the private property line shall maintain the area between the edge of pavement or curb and their property line, commonly known as parkway, in a neat, clean and orderly condition and free of any weeds, and grass or plants in excess of the provisions above. E. The owner of any vacant premises, property or lot shall be served with reasonable notice that if grass or weeds are permitted to grow in violation of the provisions of section 302.4.C, the building official may cause the grass or weeds to be cut without further notice. (Ord. 1063, 5-18-2010)
