2-3-2: DEFINITIONS:
Unless the context otherwise requires, the words or phrases defined are used in this Chapter in the sense given them in the following definitions:
ALCOHOLIC LIQUOR:
Shall include spirits, wine, beer, ale and every other liquor or solid containing alcohol, spirits, wine or beer capable of being consumed as a beverage by human beings.
ALIENABLE or TRANSFERABLE:
Shall include the sale, gift, transfer, pledge or assignment of not less than five percent (5%) of the issued and outstanding stock of a corporation in an amount equal to not less than five percent (5%) of the total stock of such corporation issued and outstanding at the time of such issuance, to a person or persons or other legal entity which was not the owner or holder of at least five percent (5%) of the stock of such corporation at the time of issuance of the present liquor license to such corporation.
BAR:
Any public place kept, used, maintained, advertised and held out to the public as a place where alcoholic liquor is offered for sale to the public for consumption on the licensed premises or for consumption off the licensed premises when sold to the public in its original package. The service of food or meals is incidental to the service of alcoholic liquor.
BEER:
A beverage obtained by alcoholic fermentation of an infusion or concoction of barley, or other grain, malt and hops in water, and includes, among other things, beer, ale, stout, lager beer, porter and the like.
BEER GARDEN:
Means (i) an open-air enclosed area connected to otherwise licensed premises and owned or rented by the licensee or (ii) an enclosed pavilion located on property that is connected to otherwise licensed premises and owned or rented by the licensee.
BOWLING ALLEYS:
Any establishment or building, or any part thereof, wherein the game of bowling with composition balls and ten wooden pins is played.
BREW PUB:
An establishment where beer is manufactured in quantities not exceeding those prescribed for a Brew Pub license by the State of Illinois in the Liquor Control Act, with the primary distribution in an adjoining restaurant where food is served.
CLUB:
A corporation organized under the laws of this State, and not for pecuniary profit, solely for the promotion of some common object other than the sale or consumption of alcoholic liquor, which conforms to the definition of a “club” in 235 Illinois Compiled Statutes 5/1-3.24, or as the same may be hereafter amended.
GAS STATION CONVENIENCE STORE:
A store engaged primarily in the retail sale of limited groceries and convenience items in connection with the sale of gasoline and/or diesel fuel, and for which the sale of alcoholic liquors is incidental.
LICENSEE:
Any person, firm, corporation, partnership or club holding a license under the provisions of this Chapter.
LIVE ENTERTAINMENT:
A person or persons acting, singing, playing an instrument, playing of prerecorded music (excluding standard juke boxes) or otherwise performing in person for compensation or profit.
MICRO-BREWERY:
An establishment where beer is manufactured in quantities not exceeding those prescribed for a Class 1 Brewer license by the State of Illinois.
MOTEL:
Every building or other structure kept, used, maintained, advertised and held out to the public to be a place where meals are actually and regularly served and consumed and where sleeping accommodations are offered for any pay to travelers and guests, whether transient, permanent or residential, in which twenty five (25) or more rooms are used for the sleeping accommodations of such guests and having one or more public dining rooms where meals are served to such guests, such sleeping accommodations and dining rooms being conducted in the same building or buildings, in connection there with, and such building or buildings, structure or structures being provided with adequate and sanitary dining room and kitchen equipment and capacity.
PACKAGE LIQUOR:
The retail sale of spirits, wine, beer, ale and every other liquor or solid containing alcohol, spirits, wine or beer capable of being consumed as a beverage by human beings for consumption in the original package off the premises where the same are sold.
RESTAURANT:
Any public place kept, used, maintained, advertised and held out to the public as a place where meals are served, and where meals are actually served without sleeping accommodations, such space being provided with adequate and sanitary kitchen and dining equipment and capacity and having employed therein a sufficient number and kind of employees to prepare, cook and serve suitable food for its guests.
SELL:
Any transfer, exchange or barter in any manner or by any means whatsoever for a consideration, and includes and means all sales made by any person whether principal, proprietor, agent, servant or employee.
SELL AT RETAIL and SALE AT RETAIL:
Refer to and mean sales for use and consumption and not for resale in any form.
TO SELL:
