§ 117.99 PENALTIES.
   (A)   Any person who commences or continues a marijuana establishment in the village, or who neglects, refuses or fails to comply with any provision of this chapter, or who causes, allows or consents to any of the same shall be deemed responsible for a violation of this chapter. A violation of this chapter is deemed to be a nuisance per se.
   (B)   A violation of this chapter is a municipal civil infraction, and a person who violates this chapter shall be subject to a fine of not less than $100 or more than $500 in the court’s discretion for each violation cited. In addition, the violator shall pay costs incurred by the village for enforcement of this chapter, which costs may include expenses, direct or indirect, that arise in connection with the municipal civil infraction. The fine and costs imposed for a violation under this section shall be in addition to rights of the village to proceed at law or in equity for other appropriate and proper remedies.
   (C)   Each day during which any violation continues shall be deemed a separate violation of this chapter for which a separate penalty may be imposed.
   (D)   In addition to the penalties stated in this section, the village may seek injunctive relief against persons alleged to be in violation of this chapter, and such other relief as may be provided by law.
   (E)   This chapter shall be administered and enforced by any ordinance enforcement officer of the village, or by such other person(s) as may be designated from time to time by the Village Council.
