§ 93.040 PLANTING PERMIT.
   (A)   The Council shall have the sole authority over planting, maintenance, and removal of trees located either completely or partially in street easements and other village property.
   (B)   No person shall plant, remove, break, spray, or take any action which would injure or destroy any tree or shrub, the base of which is located either completely or partially in a street easement or other village property, without first obtaining a permit from the Village Clerk, who shall issue the permit by and with the authority of the Village Council.
   (C)   The fee for the permit shall be determined by resolution of Village Council.

   (D)   A property owner desiring to remove a tree located on village easement at a time before it is scheduled for removal may, at their own expense, with Council permission, remove the tree in accordance with the provisions of this chapter. Removal is to include stump grinding and cleanup. The village will provide top soil and grass seed at no charge.
   (E)   A property owner may trim a tree located on village easement, at their own expense, with Council permission, provided that it is not done in a way which would injure or destroy the tree.
