§ 93.006 BOND OR DEPOSIT.
   The Village of Manchester may require a bond or deposit sufficient to cover the estimated cost of repairing the surface of a proposed excavation or opening of any street, alley, sidewalk, or other public places prior to issuing a permit therefor, when the dependability of the applicant is not sufficiently established to reasonably assure compliance with all of the provisions of §§ 93.001 et seq. In any case, the Village of Manchester shall require the bond or deposit prior to issuing the permit when the cost of repairing the surface is estimated to exceed as per Council resolution, or when the applicant has failed to comply with any provisions of §§ 93.001 et seq. in connection with any permit issued hereunder within the previous 2 years. Any public utility which fails to comply with any provision of §§ 93.001 et seq. shall thereafter be required, for a period of at least 90 days, to obtain a permit as herein provided prior to starting any excavation or opening of any street, alley, sidewalk, or other public place, and shall be subject to a bond or deposit as herein provided. The furnishing of a bond or deposit shall not be construed to exempt any public utility or person from prosecution or civil action for any violation of this code which may have caused the bond or deposit to be required.
