§ 31.34 DISPOSITION OF WEAPONS, AND THE LIKE.
   (A)   None of the provisions of this subchapter shall apply to bowie knives, dirks, slingshots, metallic knuckles, or other deadly weapons of like character. All of such weapons, except those that the Chief of Police shall deem to be of use to the Department and retain for the use of the Police Department, shall, within 60 days after their receipt, be destroyed under the direction of the Chief of Police or such person as shall be designated by him.    (B)   (1)   The Chief of Police, or such person who may be designated by him may sell at auction to federally licensed dealers all unclaimed pistols, revolvers, derringers, or other deadly weapons of like character, that have been in custody for a period of 60 days, as permitted by state and federal law. He shall fix a day upon which the sale shall take place, and shall give notice thereof by publication in a daily newspaper. The notice shall state the day, hour, and place when such sale shall commence and shall contain a general description of the property to be sold, or shall refer to a list thereof on file with the Chief of Police. Such notice shall be signed by the Chief of Police or by the person designated by him to conduct such auction.
      (2)   The proceeds of such sale, after deducting the cost of storage, advertising, selling, and other expenses incident to the handling and selling of such property shall be paid into the city general fund.
