§ 53.06 VARIANCE FROM PROVISIONS.
Upon finding that strict enforcement of this chapter would cause undue hardship to the applicant and a further finding that a variance would not be injurious to the public health, the Health Authority may authorize the issuance of a variance. The burden of proof is upon the applicant to show that the variance will not injure adjacent properties, will not conflict with the purpose of this chapter, and will not adversely affect the health of any person.
