§ 152.001 STREET GRADES ESTABLISHED BY AUTHORITY OF CITY COUNCIL; REQUIRED.
   (A)   The grades of all streets, avenues and alleys within the city shall be those fixed and established by surveys ordered by the Council and thereafter filed in the office of the City Clerk. When such surveys and profiles are approved by the City Council and filed in the office of the City Clerk, they establish the grades within their respective boundaries and with reference to which all improvements shall conform.

   (B)   In the absence of the grade having been so established, it shall be the duty of any person contemplating any improvement within the city to secure a grade from the Street Commissioner.
