(A) Municipal Building Code adopted.
(1) (a) The state’s Building Code, including all model technical codes, appendices, amendments and modifications adopted by the state’s Department of Labor and Industry (or its successor), Building Codes Bureau, applicable to local government jurisdictions, as set out in the administrative rules of the state and as amended from time to time by the Building Codes Bureau, shall be adopted by reference by an administrative order of the Mayor, as authorized by M.C.A. § 50-60-301(1)(b), as the Municipal Building Code of the city.
(b) For those jurisdictions certified to enforce the Building Code, the following codes and rules must be adopted:
1. International Building Code, 2012 edition, as amended by A.R.M. § 24.301.146;
2. International Energy Conservation Code, 2003 edition, as provided by A.R.M. § 24.301.161;
3. International Existing Building Code, 2006 edition, as provided by A.R.M. § 24.301.171; and
4. International Residential Code, 2012 edition, as provided by A.R.M. § 24.301.154.
(2) The application of the Municipal Building Code is limited to residential buildings containing less than five dwelling units or their attached-to structures, any farm or ranch building, and any private garage or private storage structure used only for the owner’s own use located within the city limits, as provided by M.C.A. § 50-6-102(1)(a). The Building Codes Bureau shall have Building Code jurisdiction over all other buildings and structures as well as Electrical, Plumbing and Mechanical Code jurisdiction over all buildings.
(3) The Municipal Building Code shall regulate the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area and maintenance of those buildings and/or structures within the city which are subject to the Municipal Building Code, and shall provide for the issuance of permits and collection of fees and penalties.
(4) Within 30 days after notice by the Building Codes Bureau of any amendments to the state’s Building Code which apply to local government jurisdictions, an administrative order adopting such amendments shall be prepared and signed by the Mayor. The administrative order is effective 30 days after it is signed.

(B) Copies on file. One copy of the Municipal Building Code shall be on file in the office of the City Clerk.

(C) Application; jurisdictional area. This section and the code herein adopted by reference shall be applicable to all buildings situated within the corporate limits of the city.
