(A) Permit application; notification of property owners. When any person, persons, firm or corporation is desirous of constructing, altering, maintaining, repairing or moving any petroleum products storage tanks in the city limits of the city, he, she or they shall make application to the City Clerk for a permit for that purpose, and the provisions of Ord. 1861 shall be followed with regard to the receipt of said application and its submission to the Council; except that, the City Clerk, in giving notice to all property owners of the application, shall notify by mail all of such property owners within a radius of 300 feet of the proposed location.

(B) Permit required. It is unlawful hereafter for any person or persons, firm or corporation to erect, place or locate, or cause to be erected, placed or located, any petroleum products storage tanks above or below the ground in the city without first having obtained a permit from the City Council therefor.

(C) Permit; city’s right to deny issue; location restriction.
(1) A permit shall not issue as a matter of right; for the welfare of its inhabitants and the protection from fire, and in the exercise of its police powers, the city, in its discretion, may issue or refuse to issue a permit to any person, persons, firm or corporation for the erection of additional petroleum products storage tanks within the limits of the city, unless the same are placed upon the right-of-way of the Great Northern Railroad Company.
(2) It is the policy of the city not to increase the number of petroleum products storage tanks now existing indiscriminately about the city, and to confine them so far as possible to the same general locality, this being along the Great Northern Railroad right-of-way through the city.
