(A) Hours of curfew. Except as herein provided, a person less than 18 years of age commits the offense of curfew violation if such person remains on the public streets within the confines of the corporate limits of the city between the following hours: every day of the week between the hours of 12:00 a.m. to 6:00 a.m. on the following day.
(B) Parental responsibility. Except as herein provided, it is unlawful for a parent or other adult person having the care and custody of a person under the age of 18 years to allow or permit such person to violate the provisions of division (A) above.
(C) Exceptions.
(1) The provisions of divisions (A) and (B) above shall not apply:
(a) When such person is accompanied by a parent or an adult acting with the express authority of a parent;
(b) When such person is upon an errand or other legitimate business for a parent or adult acting with the express authority of a parent; provided, however, it shall be presumed that no such legitimate business purpose exists unless specific written authority is in possession of the person; or
(c) When such person is going directly to or returning directly from an event sponsored by or given with express written approval of a public entity.
(2) The burden of proving the application of such exception as stated above to the curfew restrictions herein is on the person requesting the exception.
