A. Civil penalties may be levied in the manner provided by ORS 183.745 and OAR 333-157-0045.
B. A civil penalty imposed under this section shall become due and payable ten (10) days after the order imposing the civil penalty becomes final by operation of law or on appeal. A person against whom a civil penalty is to be imposed shall be served with a notice in the form and manner provided by section 3-1-3 of this chapter.
C. Any person who requests a hearing within the time allowed shall be entitled to a hearing. The hearing shall be conducted pursuant to section 3-1-6 of this chapter. If a hearing is not requested within the time allowed, a final order imposing the civil penalty shall be made. (Ord. 157, 6-14-2006)
