(A) Prohibitions.
(1) No person shall store, offer for sale, expose for sale, sell, use or explode fireworks.
(2) For purposes of this section, FIREWORKS shall mean and include any composition, substance, combinations of substances or article defined as “fireworks” in division (B) below.
(B) Fireworks; defined. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
FIREWORKS.
(a) 1. Blank cartridges;
2. Toy cannons in which explosives are used;
3. Firecrackers, torpedoes, skyrockets, Roman candles, bombs or other devices of similar construction;
4. Any fireworks containing any explosive compound; and
5. Any tablets or other devices containing any explosive substance, or containing combustible substances producing visual effects.
(b) The term FIREWORKS shall not include the following:
1. Auto flares;
2. Snake or glow worm pellets;
3. Smoke devices;
4. Trick noisemakers known as “party poppers”, “booby traps”, “snappers”, “trick matches”, “cigarette loads” and “auto burglar alarms”;
5. SPARKLERS. The term SPARKLERS means a wire or stick coated with pyrotechnic composition which may not exceed 100 grams per item, that produces a shower of sparks upon ignition. The term SPARKLERS shall not include other sparkling devices, including but not limited to items commonly known as “fountains”, “spinners”, “wheels” or similar devices, the sale and use of which is expressly prohibited;
6. Toy pistols, toy canes, toy guns or other devices in which paper or plastic caps containing twenty-five–hundredths grains or less of explosive compound are used, provided they are so constructed that the hand cannot come in contact with the cap when in place for the explosion; and
7. Toy pistol paper or plastic caps which contain less than twenty-five–hundredths grains of explosive mixture.
(C) No person shall store, offer for sale, expose for sale, sell at retail, use or explode any fireworks except as provided in rules and regulations issued by the Fire Chief and only if the person has a current permit for supervised public displays of fireworks.
