(A) The village shall bill any alarm user of each facility or premises at which an alarm system is located a show-up fee for responding to each false alarm at the facility or premises which is caused by the alarm system of any alarm user, in accordance with the following schedule:
(1) For all false alarms occurring within 30 days after registration of the alarm system by the alarm user: no fee.
(2) For all false alarms occurring during any one-year calendar period commencing January 1 of each year:
(a) One to four false alarms, no charge;
(b) Four to nine false alarms, $50 fee per false alarm; and
(c) Each false alarm after nine false alarms, $75 fee per false alarm.
(3) For all false alarms occurring without registration as required by this chapter, $75 fee per false alarm.
(B) All show-up fees shall be paid within 30 days of the date of billing unless an appeal of the fees is filed in accordance with this chapter.
(C) Each individual facility or premises at which an alarm system is located shall be counted separately and shall be billed show-up fees accordingly.
(D) Any alarm user who is billed for show-up fees by the village may appeal the billing of the fees to the Chief. Any appeal must be filed within 30 days from the date of billing.
(E) The Chief may direct abatement or refund of any billed show-up fee; provided, however, that no abatement or refund of any billed show-up fee shall be granted unless the alarm user is able to prove to the satisfaction of the Chief that no false alarm occurred or that there is an error in the total number of false alarms during any calendar year. Payment of the show-up fee which is the subject of an appeal, if the appeal is denied, shall be due within 14 days from and after the Chief mails notice of the decision to the alarm user.
