§ 31.01 DEPUTY CLERK.
   (A)   Under and pursuant to ILCS Ch. 65, Act 5, § 3.1-30-10, the Village Clerk is hereby authorized to appoint one Deputy Clerk.
   (B)   The Deputy Clerk so appointed by the Village Clerk shall have the powers of a Deputy Clerk set forth in ILCS Ch. 65, Act 5, § 3.1-30-10, to be exercised only in the absence of the Village Clerk from the place where the Village Clerk’s office is maintained, and only when either written direction has been given by the Village Clerk to the Deputy to exercise the power, or the village’s corporate authorities have determined by resolution that the Village Clerk is temporarily or permanently incapacitated to perform the function, as follows: the Deputy Clerk shall have the power and duty to execute all documents required by any law to be executed by the Village Clerk, and affix the seal of the Village Clerk thereto wherever required, and in signing any document, the Deputy Clerk shall sign the name of the Village Clerk followed with the word “By” and the Deputy Clerk’s own name and the words “Deputy Clerk”.
   (C)   The execution of any document described in division (B) above shall be conclusive evidence that the Village Clerk was absent from the place where the Village Clerk’s office is maintained and that the Deputy Clerk has been given written direction from the Village Clerk to exercise the power of a Deputy Clerk to execute the document.
