§ 90.99  PENALTY.
   (A)   A separate offense shall be deemed to have been committed each day during or upon which a violations occurs or is permitted to continue.  In accordance with G.S. § 160A-175, ( and unless this code of ordinances provides otherwise), violations of any provisions by a fine not exceeding $50 or by imprisonment not exceeding 30 days.
   (B)   The operation or maintenance of any device, vehicle, or machinery, or the keeping of animals in violation of any provision of this chapter which causes discomfort or annoyance to reasonable persons of normal sensitiveness or which endangers the comfort, repose, health, or peace of residence of this town shall be deemed, and is declared to be a public nuisance, and may be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction.
   (C)   In addition to or in lieu of remedies authorized, violations of this chapter may be prosecuted as a misdemeanor in accordance with G.S. § 160A-175.
