(A) Any operator of a mobile food cart or a mobile food vehicle must apply for and receive, on an annual basis, a mobile food permit from the Mobile Food Administrator, paying an annual fee of $100 per calendar year. Any person, firm or corporation desiring to secure a permit pursuant to this chapter shall make a written application under oath on a form provided by the City of Madisonville. Such application shall contain at least the following information:
(1) The name and permanent home address and telephone number of the applicant.
(2) The place or places where the applicant proposes to engage in business.
(3) A statement whether the applicant has previously been denied a permit under this chapter. If an applicant has had a previous permit suspended or revoked, state the reasons or circumstances surrounding the denial, suspension or revocation.
(4) The Applicant's social security number or tax identification number.
(5) A listing of the vehicle license number, vehicle description, vehicle identification number, vehicle registration papers and proof of insurance of all vehicles from which the applicant proposes to the conduct business.
(6) Evidence of a business license from the City of Madisonville.
(B) Once the application is considered complete, the Mobile Food Administrator shall issue or deny the mobile food permit. If the application conforms to the requirements of this chapter, a permit shall be issued. If the application does not conform to all requirements of this chapter, the Mobile Food Administrator shall deny the permit and inform the applicant the reasons why. All permits issued shall be subject to the following:
(1) Mobile food vendors may be inspected periodically and without notice by representatives of various city departments to ensure compliance with this chapter.
(2) All mobile food permits shall expire December 31. Reapplication shall be required upon expiration of said permit if the mobile food vendor wishes to continue activity.
(3) The Mobile Food Administrator may revoke a mobile food permit if it is discovered that any part of this chapter has been violated.
