§ 124.04 LOCATION AND HOURS OF MOBILE FOOD VENDORS.
   (A)   Mobile food vendors are allowed in non-residential zoning districts and on the properties of legally established nonresidential uses. Excepted from this requirement is a mobile food vendor that makes sales by traveling through a residential area and signaling the vendor's presence in the area by playing music and that primarily makes sales by stopping at the signal of a patron (example - ice cream truck).
   (B)   Mobile food vendors may not be located on a public right-of-way except when in conformance with (E)(1) below.
   (C)   Must be a minimum of 100 feet from a residential dwelling unless written permission is granted by the owner or tenant residing on the premises.
   (D)   A mobile food vendor shall not, during any city recognized special event, locate, operate or vend inside the event footprint nor within two blocks of said event without the express written permission of the event organizer.
   (E)   Additional guidelines for the downtown commercial core, as established by the City of Madisonville, and depicted on a map to be provided by the mobile food administrator:
      (1)   Mobile food carts are allowed on the public sidewalk so long as not parked in front of or adjacent to an existing food establishment.
      (2)   Mobile food vehicles may be allowed on public property, owned by the City of Madisonville, in preapproved designated locations provided by the Food Administrator. No more than two parking spaces may be taken up by the mobile food vehicle, driving lanes must be kept clear, and said vehicle must be removed at the end of each day.
