All employees of the city shall be covered by this subchapter except the following:
(A) Members of the City Council, the Mayor, and other elected officials.
(B) Members of appointed boards, committees, commissions, judges, and other persons performing special duties for the City Council.
(C) Any person appointed to a position designated by the City Council as excepted, which because of its nature cannot or should not be appropriately included in the regular service. Included in this category are confidential, policy determining, or key management positions. The City Council must designate any employees who are excepted by ordinance. The City Council may, by individual action, give an employee in an excepted position coverage under any part, parts, or all of the provisions of this subchapter and its supporting policies.
