Permits through the city are required for all site construction projects and/or land alteration. Depending on the amount of disturbed area, various permits are necessary. Permit levels and parameters are as follows:
(A) Level 1. Site construction of one disturbed acre or greater is required to file for a permit accompanied by a Grading Plan and EPSCP Plan/Erosion Prevention and Sediment Control Plan, and a SWPPP Plan as well as a Kentucky Division of Water Notice of Intent (NOI).
(B) Level 2: Utility companies shall apply for a general permit from the city for land disturbance operations less than one acre; this permit must be renewed every three (3) years.
(1) Coordination by the contractor with the Kentucky Division of Water and the US Army Corps of Engineers to determine whether additional permits are required from those agencies before construction begins.
(2) No permit through the city is required for the following activities:
(3) Any emergency activity that is immediately necessary for the protection of life, property, or natural resources provided surface restoration is accomplished as soon as reasonably practicable after the emergency has been addressed.
