§ 160.02 INTRODUCTION.
   (A)   In compliance with our National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) Phase II program, the city has created this chapter to provide a comprehensive stormwater management program. The requirements herein are applicable to all stormwater infrastructure owned or regulated by the city.
   (B)   During the construction process, soil is highly vulnerable to erosion by wind and water. Eroded soil endangers water resources by reducing water quality and causing the siltation of aquatic habitat for fish and other desirable species. Eroded soil also necessitates repair of sewers, ditches and the dredging of lakes. In addition, clearing and grading during construction cause the loss of native vegetation necessary for terrestrial and aquatic habitat.
   (C)   Construction site operators must implement appropriate erosion and sediment control (BMPS) that, at a minimum, shall be protective of Kentucky’s General Permit for Stormwater Construction Site (KYR 100000).
