(A) It is generally recognized that the types of fuel used, and the scale and duration of burning by exterior solid fuel heating devices creates noxious and hazardous smoke, soot, fumes, odors and air pollution, can be detrimental to citizens’ health, and can deprive neighboring properties of the enjoyment and full use of their property or premises.
(B) Therefore, with the adoption of this subchapter, it is the intention of the city to prohibit the use of exterior solid fuel heating devices in limits of Madison for the purpose of securing and promoting public health, safety, and general welfare of the city and its inhabitants.
