A list of the users which are found to be in significant noncompliance (SNC), violating applicable pretreatment requirements or national categorical pretreatment standards during the 12 previous months may be annually published by the city in a local newspaper. The notification shall also summarize any enforcement actions taken against the user(s) during the same 12 months. For the purposes of this provision, significant noncompliance violations would be those violations which remain uncorrected days after notification of noncompliance; which are part of a pattern of noncompliance over a 12 month period; or which involve a failure to accurately report noncompliance; or as described in the definition section of this document.

Any user violating any of the provisions of this subchapter or who has a discharge which causes a deposit, obstruction, damage or other impairment to the city's wastewater treatment system shall become liable to the city for any expense, loss, or damage caused by the violation or discharge. The city may add to the user's charges and fees the costs assessed for any cleaning, repair, or replacement work caused by the violation or discharge. Any refusal to pay the assessed costs shall constitute grounds to deny discharge into the city's sewer system and may be assessed against the real property as a special assessment. Any person violating any of the provisions of this subchapter shall become liable to the city for any expense, loss, damage occasioned by the city by reason of such violation.

Any person who knowingly makes any false statement, representation or certification in any application, record, report, plan or other document filed or required to be maintained pursuant to this subchapter or wastewater discharge permit, or who falsifies, tampers with, or knowingly renders inaccurate any monitoring device or method required in § 52.67 shall be guilty of a misdemeanor.

Any person violating any provision of this chapter is guilty of a misdemeanor. In addition, the city shall be entitled to seek any other remedy available at law or in equity in order to protect the health, safety, and welfare of the community, including temporary and permanent injunctions.
