§ 111.53 SOLID WASTE MANAGEMENT FEE; FUND ESTABLISHED.
   (A)   In accordance with 415 ILCS 5/22.15(J)(1), a solid waste management fee to be assessed and collected by the county is hereby established. Said fee shall be $0.40 per cubic yard of solid waste deposited in landfills operating in the county, unless the owner or operator weighs the quantity of the solid waste received with a device for which certification has been obtained under the Weights and Measures Act, being 225 ILCS 470/1 et seq., in which case the fee shall be $0.95 per ton.
   (B)   Collection of said fees shall begin and be in accordance with payment schedules set by the state. Such fees shall be made payable to the County Treasurer, by the owners and operators of the landfills located in the county, and retained by him or her in a fund designated as the Solid Waste Management Fund. This Fund shall be accounted for by the County Auditor. The County Board shall make expenditures from this Fund for payment of any cost related to solid waste management.
   (C)   The County Board may, by resolution, enter into an agreement with the owner or operator of any landfill in the county, whereby said owner or operator agrees to undertake a contractual obligation to pay certain sums to the county in lieu of the solid waste management fees provided for in division (A) of this section. If the owner or operator of a landfill in the county has entered into an agreement as authorized by this division (C), the amount of solid waste management fee provided in divisions (A) above shall be reduced equal to the newly imposed host fee. If such an agreement expires or is terminated by either party, the exemption from the payment of the solid waste management fees provided for in division (A) above shall be revoked and the owner or operator of the landfill shall resume payment of the solid waste management fees provided in division (A) above.
