(A) Regulations. Sump pump discharge in any manner other than as specified by this section shall constitute a violation thereof and shall subject the offender to penalties as set forth in this chapter.
(B) Connection. Every foundation drain shall be connected to a sump pit containing an approved sump pump pursuant to the regulations set forth in the plumbing regulations of the state, and as specified elsewhere in the county building and zoning code.
(C) Installation. Sump pumps are to be installed for the purpose of discharging clear water from foundation drains and ground infiltration and shall either discharge into an underground conduit leading to a drainage ditch for that purpose, or shall discharge onto the ground of the property owner at least two feet or more from the building from which the water is being pumped, and not closer than ten feet from the property of adjacent owners or roadside ditches. The point of discharge shall be determined at the point where the water is discharged upon the ground.
(D) Road Commission; roadside ditches. Nothing in this section shall interfere with the ability of the local Road Commissioner to allow or prohibit discharges into roadside ditches.
(E) Drainage facilities; alteration or interference. No property owner shall willfully alter, interfere with or block access to drainage facilities that were constructed as subdivision or development improvements.
(F) Violation. No water shall be discharged from a sump pump if the discharge creates icing problems on roads or walkways, or creates a situation causing damages to roads or to property or creates ponds of standing or stagnant water.
(G) Correction. If such condition exists or is created, the Building Official shall require the owner of the property discharging the water to install an underground lateral or surface discharge connection which shall cause the water from the sump pump to be discharged in such a manner as not to interfere with the use of property by adjacent property owners.
