§ 77.16 EXEMPTIONS.
   (A)   Physicians licensed by the state who perform either independent of or in connection with body art procedures as part of patient treatment are exempt from these regulations.
   (B)   Individuals who pierce only the outer perimeter and lobe of the ear using a pre-sterilized single use stud and clasp ear piercing system are exempt from these regulations. Under no circumstances shall ear piercing studs and clasps be used anywhere on the body other than the outer perimeter and lobe of the ear. Individuals who use ear-piercing systems must conform to the manufacturer’s directions on use and applicable United States Food and Drug Administration requirements. The Department retains authority to investigate consumer complaints relating to alleged misuse or improper disinfection of ear piercing systems.
