(A) All drug paraphernalia is subject to forfeiture.
(B) Property subject to forfeiture under this subchapter may be seized by any peace officer upon process issued by any court having jurisdiction over the property. Seizure by a peace officer without process may be made under the following conditions:
(1) The property subject to seizure has been the subject of prior judgment in favor of the state in a criminal proceeding or in an injunction or forfeiture proceedings;
(2) There is probable cause to believe that the property is directly or indirectly dangerous to the health or safety; and
(3) In accordance with the State Code of Criminal Procedures of 1963, as amended.
