§ 9-3-01 TEMPORARY USE OF UTILITIES.
   (A)   Use of temporary power poles. The City Building Division shall give authorization for the setting of an electrical meter on a temporary power pole for residential, commercial or industrial construction to Pacific Gas and Electric Company upon the installation of a temporary power pole by the applicant and after inspection and approval of the electrical meter panel together with the associated wiring by the City Building Division.
   (B)   Residential construction.
      (1)   Authorization for the setting of an electrical meter for new residential construction, when located on the electrical service panel serving residential unit, shall be given to Pacific Gas and Electric Company upon:
         (a)   The completion of a Temporary Power Agreement with the city, as approved by and signed by the Building Official or his/her designee; and
         (b)   Inspection approval of the electrical meter panel together with the associated wiring by the City Building Division.
      (2)   Prior to final inspection and occupancy authorization for the setting of a gas meter for new residential construction during the months of December, January, February and March shall be given to Pacific Gas and Electric Company upon:
         (a)   The completion of a Temporary Power Agreement with the city, as approved by and signed by the Building Official or his/her designee; and
         (b)   Inspection approval of the associated gas piping.
   (C)   Commercial and industrial construction. Authorization for the setting of an electrical meter and/or gas meter for new commercial or industrial construction shall be given to Pacific Gas and Electric Company upon:
      (1)   The completion of a Temporary Power Agreement with the city, as approved by and signed by the Building Official or his/her designee; and
      (2)   Inspection approval of the electrical meter panel together with the associated wiring, and/or inspection approval of the associated gas piping by the City Building Division.
   (D)   Enforcement and penalties.
      (1)   Temporary Utilities Certificates and Temporary Power Agreements authorize the connection of electrical and/or gas utilities on a temporary basis. Approval or acceptance or issuance of a Temporary Utilities Certificate and/or Temporary Power Agreement shall not constitute approval for occupancy.
      (2)   In the event of an unapproved occupancy the contractor, owner and tenant will be notified, and given no more than three working days to complete and final the project or obtain a temporary occupancy permit as authorized under Section 309{.4} of the Uniform Administrative Code as adopted by the city.
      (3)   If the contractor, owner or tenant fails to respond or fails to proceed to complete all required items by the time limit given in the Temporary Occupancy Permit, the Temporary Power Agreement and the Temporary Occupancy Permit shall become void.
      (4)   In addition, no other temporary electrical meter releases, excluding temporary power poles, will be approved or issued to the contractor in violation for a period of 180 days for residential uses and 360 days for commercial/industrial uses from the date of notification of violation of unapproved occupancy or the date of final inspection and final occupancy approval by the City Building Division and other city departments as required for the structure occupied prior to final occupancy approval, whichever occurs last.
