§ 36.04  ANTI-DRUG AND ALCOHOL MISUSE POLICY FOR PUBLIC TRANSPORTATION.
   (A)   The county shall adopt this policy to assure worker fitness for duty and protect our employees, passengers, and the public from the risks posed by the misuse of alcohol and use of prohibited drugs.
   (B)   The county policy exceeds all applicable federal regulations governing workplace anti-drug and alcohol programs in the transit industry.
   (C)   The county policy mandates urine drug and alcohol testing for safety-sensitive positions and prohibits performance of safety-sensitive functions when there is a positive result or a refusal to test, per U.S. Department of Transportation regulations 49 CFR Part 655.
   (D)   The county policy sets standards for the collection of urine and alcohol specimens per U.S. Department of Transportation Regulations 49 CFR Part 40.
   (E)   The county policy provides for zero tolerance, which results in termination of any employee that tests positive or refuses to test during their employment.
   (F)   The Administration of the County Public Health Department is hereby authorized to provide the administration of this policy.
