§ 33.04 TERMS OF COUNTY BOARD MEMBERS AFTER REAPPORTIONMENT.
   The following procedure shall be used to determine the terms of the County Board members elected at the general election immediately following a decennial reapportionment and their successors.
   (A)   The members of each district shall be divided into three groups in the manner set forth below.
      (1)   Members in group A will serve terms of two years, four years, and four years.
      (2)   Members in group B will serve terms of four years, two years, and four years.
      (3)   Members in group C will serve terms of four years, four years, and two years.
   (B)   At the organizational meeting of the County Board held following the general election immediately following a decennial reapportionment, the County Clerk shall prepare an opaque bag containing three balls of the same color, shape, size, and material. The balls shall be distinctly and separately labeled A, B, and C. The Clerk shall ensure that no person reaching into the bag can see or detect the label of the ball he or she might pick.
   (C)   The members from District 1 shall come forward and select one ball each from the bag. Members shall draw in the order of their vote share in the most recent general election. The member who received the highest number of votes shall draw first; the member who received the second highest number of votes shall draw second, and so forth. In the event that members received an identical number of votes, the members shall draw in alphabetical order by last name. If those members have the same last name, the order will be determined by a coin flip conducted by the County Clerk.
   (D)   After the members of District 1 draw, the balls shall be placed back into the bag and members of District 2 shall draw and continue in order of districts until all members have been divided into groups.
   (E)   All drawings must occur in full view of the others members of the Board and any other persons present at the meeting.
   (F)   The County Clerk shall record the letter drawn by each member and use the information to determine the seats up for election in future elections.
