(A) Section 52.03(A) shall not apply to new common sources of sanitary pollution, as specified pursuant to § 17 of the Act and the regulations adopted thereunder by the Agency, including but not limited to the following: privies, septic tanks, cesspools, sewers (storm, sanitary, combined, and sewer service connections), subsurface seepage-disposal lines, pits, or ponds receiving fluids such as surface waters, oils, and grease, and flood waters.
(B) However, no common sources may be located within the applicable minimum distance from a community water supply well specified by the regulations.
