§ 91.42 REFUSAL OF ENTRY.
   (A)   If a person denies access to the Health Authority, the Health Authority shall inform the person that:
      (1)   The permit holder is required to allow access to the Health Authority;
      (2)   Access is a condition of acceptance and retention of a permit to operate; and
      (3)   If access is denied, the Health Authority will take such legal action as required.
   (B)   If the person in charge denies the Health Authority access to a permitted food establishment pursuant to § 91.41, the Health Authority may gain access in a manner provided by law. In addition, the Health Authority may issue a cease and desist order, or seek a temporary restraining order, or other relief, to cease the food establishment's operations until the inspection is conducted.
