§ 94.99 PENALTY.
   (A)   It shall be unlawful to violate any of the terms and provisions of this chapter. Any person found to have violated this chapter shall be fined not less than $50 and not more than $500 for a first offense and shall be fined not less than $100 and not more than $1,000 for a subsequent offense which occurs less than two years after the prior offense. If a subsequent offense occurs more than two years after a prior offense, it shall be treated as a first offense.
   (B)   Each day that a violation of this chapter occurs shall be considered a distinct and separate violation.
   (C)   In addition to any penalty provided by this chapter, the Macon County State’s Attorney is authorized to initiate action to obtain injunctive relief in the Circuit Court, including, but not limited to, the issuance of a temporary restraining order and preliminary injunction, in order to abate any such nuisance condition as enumerated in this chapter.
