§ 54.12 VARIANCES.
   If conditions exist at a proposed installation site which precludes compliance with the requirements of this chapter, a variance shall be requested and shall be approved prior to beginning any geothermal system construction. The contractor, driller, and/or excavator must make written request outlining a specific proposal to be used in lieu of compliance with this chapter. A County Health Department official will review the requested variance, and may ask for additional information. If in the opinion of the County Health Department official a health hazard or nuisance will not result from this variance, the variance shall be granted, The County Health Department will notify the contractor, driller, and/or excavator in writing of its decision either to grant or deny the variance. A variance shall not be granted for a potential route distance.
