Hearings held pursuant to this section shall be held within ten working days after receipt of the request for hearing. Such hearings shall occur at the Macon County Health Department before the Macon County Board of Health. The Board of Health shall receive evidence from the Department and from the requester, if the requester chooses to present evidence. Upon a finding that the Department has proved, by a preponderance of the evidence, that a violation of this subchapter has occurred, the Board shall affirm the revocation, or it may modify the terms of said revocation as it deem necessary to promote the public safety and welfare.
