§ 52.52 VARIANCES.
   (A)   If conditions exist at a proposed installation site which precludes compliance with the requirements of this subchapter, a variance shall be requested and shall be approved prior to beginning any construction. The closed loop well contractor must make written request outlining a specific proposal to be used in lieu of compliance with this subchapter. The request shall include a plot plan of the property, showing lot size, the locations of sewers, septic tanks, buildings, seepage fields, and other sources of contamination on the property and adjacent property, with distances shown to the proposed closed loop well. A description of geologic and soil conditions shall also be included, A County Health Department official will review the requested variance, and may ask for additional information. If in the opinion of the County Health Department official a health hazard or nuisance will not result from this variance, the variance shall be granted. The County Health Department will notify the closed loop well contractor in writing of its decision either to grant or deny the variance.
   (B)   A variance shall not be granted for a potential route distance.
