§ 113.22 NONCONFORMING FACILITIES.
   Towers, antennas, and antenna facilities in existence on, or approved prior to, the effective date of adoption or amendment of this chapter which do not conform to or comply with the regulations of this chapter shall be allowed to continue to exist and to be used, subject to the following provisions:
   (A)   Routine repairs and maintenance shall be permitted and encouraged, to prevent structural failure, to an extent not to exceed one-half of the fair market value of the nonconforming tower, antenna, or antenna facility;
   (B)   Nonconforming towers, antennas, or antenna facilities shall not be moved, replaced, enlarged, structurally altered, or modified unless the action decreases its nonconformity; and
   (C)   Nonconforming towers, antennas, or antenna facilities which are damaged or destroyed by any means to an extent exceeding one-half of the fair market value of the nonconforming tower, antenna, or antenna facility shall not be replaced or reconstructed except in conformance with all of the requirements of this chapter.
