797.05 DEFINITIONS.
   For the purpose of this regulation, the following terms shall have the meaning herein indicated:
   (a)   DISPENSARY: Shall have the same meaning as in Ohio Administrative Code 3796:1-1-01, or as set forth in any subsequent or similar regulation(s).
   (b)   GOOD CAUSE: For purposes of refusing or denying a license renewal, reinstatement, or initial license issuance, means:
      (1)   The licensee or applicant has violated, does not meet, or has failed to comply with any of the terms, conditions, or provisions of this chapter, the Ohio Medical Marijuana Control Program Code, Ohio Department of Commerce or any rules or regulations promulgated thereunder;
      (2)   The licensee or applicant has failed to comply with any special terms or conditions that were placed on its license; or
      (3)   The licensed premises have been operated in a manner that adversely affects the public health or welfare or the safety of the immediate neighborhood in which the establishment is located.
   (c)   LICENSE: To grant a license or registration pursuant to this chapter, the Ohio Medical Marijuana Control Program Code, and the Ohio Department of Commerce.
   (d)   LICENSED PREMISES: The premises specified in an application for a license which is owned or in possession of the licensee and within which the licensee is authorized to distribute or sell medical marijuana in accordance with the provisions of this chapter, the Ohio Medical Marijuana Control Program Code, and the Ohio Department of Commerce.
   (e)   LICENSEE: A person licensed or registered pursuant to this Chapter and the Ohio Medical Marijuana Control Program Code.
   (f)   LOCAL LICENSING AUTHORITY: The City Council of the City of Macedonia, unless the City Council of Macedonia designates other persons to serve as the local licensing authority.
   (g)   LOCATION: A particular parcel of land that may be identified by an address or other descriptive means.
   (h)   MEDICAL MARIJUANA: Marijuana that is cultivated, processed, dispensed, tested, possessed, or used for a medical purpose authorized by O.R.C. Chapter 3796.
   (i)   PERSON: A natural person, partnership, association, company, corporation, limited liability company, or organization, or a manager, agent, owner, director, servant, officer, or employee thereof.
   (j)   PREMISES: A distinct and definite location, which may include a building, a part of a building, a room, or any other definite contiguous area.
   (k)   SCHOOL: A public or private preschool or a public or private elementary, middle, junior high, or high school.
   (l)   STATE LICENSING AUTHORITY: The Ohio Department of Commerce that regulates and controls the licensing of medical marijuana cultivators, processors and dispensaries in Ohio.
   (m)   PROCESSOR: An entity that has been issued a certificate of operation by the Ohio Department Of Commerce to manufacture medical marijuana products.
